Terms of Use

These Terms of Use (the "Terms") govern your use of Poker Chips Manager (the "Service"), operated by Masahiro Kato, an individual based in Japan ("we", "us"). By using the Service you agree to these Terms.
This is an English translation provided for convenience. The Japanese version is the operative text, and it prevails in the event of any inconsistency.
1. What the Service is
The Service is a tool that keeps track of chip counts, bets and the flow of a poker game played for entertainment with physical playing cards. It does not deal cards, it does not host games between users, and it does not handle any form of stake.
Gambling — wagering money or anything else of monetary value, including prizes that can be exchanged for money — is prohibited on the Service without exception. Gambling is a criminal offence under Japanese law, and the Service must not be used to facilitate it. You are responsible for ensuring that the way you use the Service is lawful where you are.
2. Things you must not do
When using the Service, you must not:
- break any applicable law, or act against public order and morals;
- use the Service in connection with any criminal activity;
- use the Service to wager money or anything of monetary value, including redeemable prizes;
- damage or interfere with the servers or network used to provide the Service;
- otherwise disrupt the operation of the Service;
- collect or store personal information about other users;
- use the Service for any fraudulent or deceptive purpose;
- do anything else we reasonably consider inappropriate.
3. Your data
Game settings and game progress are stored in your own browser's local storage and are not transmitted to us. We cannot recover them for you, and clearing your browsing data will delete them. What we do collect through analytics and advertising is described in our Privacy Policy.
4. Paid features
The Service is free to use. You may optionally purchase an ad-free period. Payments are processed by Stripe; we never receive or store your card details. Access is granted immediately after a successful payment and lasts for the period stated at the time of purchase.
Because access is delivered immediately and in full, purchases are non-refundable except where a refund is required by law, or where the paid feature fails to work for reasons attributable to us. If something has gone wrong with a purchase, contact us and we will look into it.
Paid features are not offered to customers in the European Union, the European Economic Area or the United Kingdom. Purchase attempts from those regions are declined. The Service itself remains free to use there.
5. Availability and changes
We may change, suspend or discontinue any part of the Service. We will give notice of significant changes where it is reasonably possible to do so, but the Service is provided on an "as available" basis and we do not guarantee uninterrupted operation.
6. Disclaimers and liability
- The Service is provided "as is". We do not warrant that it is free of errors, or that it is accurate, complete or fit for any particular purpose.
- We are not a party to, and accept no responsibility for, disputes between players about a game, its result or its stakes.
- We do not control the content of the advertisements shown on the Service or of any external site you reach from it, and we are not responsible for them.
- To the fullest extent permitted by applicable law, we are not liable for any loss arising out of your use of, or inability to use, the Service.
- Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited — including liability for our own intentional misconduct or gross negligence, and any rights you have as a consumer under the mandatory law of your country of residence.
7. Changes to these Terms
We may update these Terms. The revised version takes effect when it is posted on this site, and we will give advance notice of material changes where reasonably practicable. Continuing to use the Service after a change means you accept the updated Terms.
8. Governing law and jurisdiction
These Terms are governed by the laws of Japan. Any dispute arising from the Service will be submitted to the exclusive jurisdiction of the court with jurisdiction over our location in Japan. If you are a consumer, this does not deprive you of the protection of the mandatory consumer-protection rules of your country of residence, or of your right to bring proceedings in the courts of that country where the law gives you that right.
